Murder accused in segregation

A man accused of the bashing murder of a young Wallerawang father during an alleged assault at a Wallerawang hotel two months ago has made a brief appearance in Lithgow Court on Thursday.

Nathan George Hutchison, 32, a railway employee, of Dubbo, was handcuffed and guarded in the dock by two Corrective Services officers during brief proceedings before magistrate Ms G Knight.

Hutchison turned and waved to members of his family in the public gallery as he was escorted into the Court to be charged with the murder of Troy Donald Blyth on the night of May 25 this year.

No evidence was given or plea entered before Director of Public Prosecutions representative Evan Dowd and Hutchison’s legal representative, Ken Lambeth, from the Aboriginal Legal Aid Service, both sought an adjournment.

Mr Lambeth applied for the matter to be adjourned to Bathurst Local Court.

He said that for the hearing at Lithgow the prisoner had to be brought from Parklea Prison and accommodated at Bathurst Correctional Centre.

He said that because a Corrective Services officer at Bathurst was a relative of the victim in the matter the defendant was kept in segregation, allowed out of his cell for only 45 minutes a day.

He claimed this was excessively harsh.

Mr Lambeth said that transferring the matter to Bathurst also made it more convenient for the family of the defendant to attend Court from Dubbo.

He said that a DPP officer and the detective in charge of the investigation were also stationed in Bathurst.

Magistrate Knight agreed to an adjournment to Bathurst Local Court on October 13 where the defendant can appear by video link.

She said the lengthy adjournment should enable the relevant parties to have their briefs prepared to be able to proceed on that day.

Bail was not applied for and was formally refused.
