Appeal follows jail sentence

A young man had lodged an appeal against prison sentences relating to incidents that occurred following end of season rugby league celebrations in Portland last year.

Pleading guilty to several charges in the latest Lithgow Court was 23 year old Joshua Hartfield, of Portland.

He was charged with two counts of common assault, two of resisting arrest and one of malicious damage.

He was also called up for breach of the conditions of a pre existing good behaviour bond.

The Court was told that Hartfield had been following end of season celebrations by the Portland football club and in the early morning of August 20 had attempted to enter the Coronation Hotel from where he had been barred some time earlier.

When refused entry he punched a hotel employee a number of times.

He returned later by another door, this time attempted to drag the licensee down the steps and kicking a door, breaking its closing device.

After the doors were locked he remained outside banging on windows, shouting abuse and attempting to start fights with members of the public.

When police arrived at his home soon afterwards he struggled with the arresting officers and had to be forcibly restrained.

Magistrate Ms G Knight sentenced Hartfield to six months jail on each charge and on the breach of bond but as all but one of the sentences were concurrent the cumulative term was 12 months, with a non parole period of six months.

He later lodged an appeal on the grounds of severity and was allowed conditional bail pending the hearing of the appeal in the District Court at Bathurst.
